The guidelines and rules that apply when you utilize BuilderWorks to post projects, submit custom quotes, communicate via chat, or use our digital workflow tools.

These Terms and Conditions ("Terms") govern your access to and use of the BuilderWorks website, applications, and related services (together, the "Platform"), operated by BuilderWorks ("we", "us", "our"). By creating an account, browsing, posting a job, submitting a quote, or otherwise using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.
1. Who these terms apply to
These Terms apply to all users, including homeowners and other customers seeking services ("Customers") and trade professionals, contractors, or businesses offering services ("Trade Professionals"). If you use the Platform on behalf of a company or other organisation, you represent that you have authority to bind that entity, and "you" includes the entity and its personnel.
2. What BuilderWorks provides
The Platform is an online venue that helps Customers and Trade Professionals find each other, communicate, and (where available) manage aspects of jobs such as quotes or messaging. We are not a party to any contract for work carried out between users. We do not employ Trade Professionals, supervise work, guarantee outcomes, or warrant the quality, legality, timing, or price of any services. Users contract directly with each other unless we expressly state otherwise in writing for a specific product or feature.
3. Accounts and eligibility
You must provide accurate registration information and keep it up to date. You are responsible for all activity under your account and for safeguarding your credentials. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform. We may refuse registration, suspend, or close accounts where we reasonably believe there is fraud, risk to other users, or a breach of these Terms.
4. User conduct
You agree not to: misuse the Platform or attempt to circumvent security; harass, defraud, or mislead other users; post false, illegal, or infringing content; scrape or automate access except as we expressly permit; solicit users to complete transactions off the Platform primarily to avoid applicable fees or protections where those apply; or use the Platform in any way that violates law or third-party rights. We may remove content, restrict features, or terminate access where we reasonably consider it necessary for safety, compliance, or the integrity of the Platform.
5. Jobs, quotes, and agreements between users
Descriptions, quotes, and agreements are between Customers and Trade Professionals. You are responsible for verifying licences, insurance, qualifications, and suitability for your project. Any dispute about workmanship, payment, delays, or scope is primarily between the parties involved. We may offer tools or optional programs (for example verification or payment features) from time to time; where we do, additional terms may apply and will be presented separately.
6. Fees and payments
If we charge subscription, listing, or transaction fees, the amounts and billing cycle will be shown at checkout or in your account. Unless stated otherwise, fees are non-refundable except where required by law. Third-party payment providers handle card and bank processing under their own terms; we are not responsible for their downtime or errors beyond our reasonable control.
7. Content and intellectual property
You retain ownership of content you upload, but you grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute that content as needed to operate and promote the Platform. Our name, logos, and the Platform's look and feel are our property or our licensors'. You must not copy or misuse them without our prior written consent.
8. Privacy
Our collection and use of personal information is described in our Privacy policy. By using the Platform, you acknowledge that we process personal information as described there.
9. Disclaimers
To the fullest extent permitted by law, the Platform and all content are provided "as is" and "as available". We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement, except any that cannot be excluded under applicable law (including the Canada Consumer Law, where it applies).
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Platform or any services arranged through it. Where our liability cannot be excluded, it is limited (at our option) to resupplying the relevant services or paying the cost of resupply, or, where related to paid Platform fees in the twelve months before the claim, that amount. This section does not limit liability that cannot be limited under applicable law.
11. Indemnity
You agree to indemnify and hold harmless BuilderWorks and our officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, your breach of these Terms, or your relationship with other users, except to the extent caused by our gross negligence or unlawful conduct.
12. Suspension and termination
You may stop using the Platform at any time. We may suspend or terminate access with or without notice where we reasonably believe you have breached these Terms, pose a risk, or must do so to comply with law. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive termination.
13. Changes
We may change these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date. If changes are material, we will provide additional notice where required by law. Continued use after the effective date constitutes acceptance of the updated Terms.
14. General
If any part of these Terms is held invalid, the remainder remains in effect. Failure to enforce a provision is not a waiver. These Terms are governed by the laws of Canada, and you submit to the non-exclusive jurisdiction of the courts of that jurisdiction, except where mandatory consumer protections in your location require otherwise.
